Description

Following a jury trial, defendant Cora Jean Higginbotham was convicted of aggravated robbery, a first degree felony, and possession of a dangerous weapon by a restricted person, a third degree felony. The convictions resulted from the armed robbery of an Ogden, Utah, convenience store in January 1994. For the first degree felony, Higginbotham was sentenced to a term of five years to life, with an additional, consecutive two-year penalty enhancement under Utah Code Ann. ยง 76-3-203(1). The trial court imposed a concurrent zero- to five-year term for the third degree felony.
